How Long Is The Probate Timeline?

Probate can take anything up to 12 months, and it’s a particularly complex case then it might be even longer – that’s most likely if there’s a challenge to the will, or there isn’t a valid will, or if there’s an issue getting a grant of probate.

On average, probate takes around 6 months, and it can feel like a protracted process at times.

Applying for probate can be broken down into several stages, the first of which is registering the death.

This must be done within five days of the death in England, Wales, and Northern Ireland, and you’ll then be given a death certificate as confirmation.

After that, the rest of the process will work as follows:

  • Step one is to gain a valuation on the estate
  • You’ll then file inheritance tax (IHT) forms
  • After this, probate applications will be filed
  • Then probate fees will be paid
  • And finally, IHT will be paid

Applying for probate online can be done via the GOV.UK website, and applications can take around 8 weeks to process.

Crucially, however, you must have an estimate on the value of the estate to find out whether you’ll be liable to pay any Inheritance Tax on the estate, and if so, how much it will be.

If there is inheritance tax to pay, then you’ll need to wait 20 working days after sending the relevant tax forms to HMRC before you can apply for probate online.

How Do I Know If I Need Probate?

Probate is required when someone has died and you’re looking to gain access to their estate to distribute assets to their beneficiaries.

The process is standardised in the UK, and the process begins by obtaining a death certificate.

This must be done within 5 days of the death, and nothing can happen without this step as all organisations will require a copy as proof of their death and to pass fraud checks.

You’ll then need to get a valuation on the estate, which means contacting banks, pension providers, lenders, local authorities, investment brokers, HMRC, the Department for Work and Pensions, and any other organisations they might have funds or liabilities with.

Crucially, a grant probate is required on most estates with a value of £10,000 or more.

This figure can be as low as £5,000 or as high as £50,000, and it’ll depend entirely on the financial institution or places that hold the majority of the assets or finances.
